In the matter of Philip Moser Will.
I, Henry W. Smith, Clerk of Probate Court of Floyd County, Indiana, certify that on the 10th December 1840 David Sillings and William Russell appeared personally before me at my office and having been duly sworn did depose and say that the original instrument filed in my office and of which the following is a true copy, and purporting to be the last will and testament of Philip Moser therein named, of county of Floyd, deceased, was duly signed and sealed by the sd. Philip Moser on the day of the date thereof in the presence of sd. David Sillings and William Russell who signed their names as subscribing witnesses at the request of sd. testator to the due Execution thereof by him and in there presence and the sd. testator in the presence of the sd. deponents and the sd. deponents further say that they understood and verily believe that sd. testator was at the time of the Execution thereof, of sound deposing mind and memory, and that he has since deceased.
In the name of God, Amen, I Philip Moser of County of Floyd, State of Indiana, being weak in body but of sound and perfect mind and memory, Blest be almity[sic] god for the same do make and publish this my last will and testament I give and bequeath unto Jacob Burkhart the Southwest quarter of Land in Section 34 in township 2 Range 5 E where I now live on except what I sold to James Hickman it being about 7 acres providing sd. Burkhart will pay $700 as follows to wit to my son John Moser - $100 within 1 year after my death to my son Fredericks children $100 within 2 years of my death to my daughter Elizabeths children $100 within 3 years to Magdalena my Daughter to her children $100 within 4 years affer my death to my daughter Eve $100 within 5 years after my death to my daughter Mary $100 within six years after my death to my daughter Sally $100 after my death seven years the balance of my estate I want sold at public sale together with my personal property and the money aquilly[sic] divided to my children to those that are alive and to those that are dead a childpart to there children as they become of age, except my son George he is to have no part I consider he has already got his. I want my grandchild Patsey Burkhart to take care of the house and property that is in it from my death until there can be a sale and I give and bequeath her one bed and bedding. I also appoint my son John Moser and Jesse Hickman my Executors of this my last will and testament in witness thereof I have hereunto set my seal this 29th day of January 1837.

Page 300. Thursday Feb. 17, 1848. #429. Estate and Will of Philip Moser. Ordered that a citation be issued against John Moser and Jesse Hickman, the Executors to sd. will, requiring them to appear here on the 1st day of next Term to show cause if they can, why sd. estate has not been settled up.
Page 312. May 15, 1848. Came Jesse Hickman, Administrator of sd. estate and makes report and files vouchers herein showing a full and final settlement of sd. estate. It is ordered that sd. administrator be fully discharged from all liabilities, duties and trusts connected with sd. estate.
